Webinar 2023 « Regulations relating to the traceability of excavated soil and materials ».
To support its clients – groundworks and haulage companies, and producers of excavated soil – ECT presents the latest regulatory changes in the traceability of urban soil.
The webinar organised by ECT on 13 and 20 January, and run by Reda Semlali, tackled the basics of the status of waste and the practical aspects of implementation: Keeping a chronological register, the requirement to copy it to RNDTS (the French national waste register), the REP Bâtiment (legal requirements for broader producer responsibility in the construction industry), etc.

So that those concerned can get to grips with the new record-keeping gradually, a transition period or tolerance period began in 2022.
EXCAVATED SOIL
- From 1 May 2023, sending the data from the chronological register to the national RNDT register will be obligatory, with retrospective effect to 1 January 2023.
- Keeping a chronological register has been obligatory since 1st January 2022, with a three-year data retention period
RUBBLE & CONCRETE BLOCKS
Similar requirements also come into effect in 2023 for non-dangerous waste (rubble, concrete blocks).
SUPPORT FROM ECT
ECT has for some years maintained a chronological register, a database and a client interface. The client area on the Extranet makes available to our customers all the date-stamped data relating to reception of soil and materials on our sites. For example the DAPs (requests for prior approval), unloading certificates, detailed statements, etc.
For a better understanding of the information to keep and the information to send, two explanatory documents are available for our customers.
New in 2023, rollout of the new REP (French regulations for broader producer responsibility) for PMCBs (products and materials from the construction of buildings).
These are the ‘REP Bâtiment’: What do they do?
Under AGEC (the French law relating to the struggle against waste and for a ‘circular economy’) a REP (regulations for broader producer responsibility) has been set up for PMCBs, with effect from 1st January 2023. This ‘REP Bâtiment’ applies broader producer responsibility to the construction sector. One of the objectives of this law is to combat fly tipping.
To respond to this new obligation, those who place PMCBs on the market must be members of an ‘éco-organisme’ or eco-friendly waste management organisation. This membership transfers their duty in return for a financial contribution. The role of ‘éco-organismes’ is to roll out circular economies in various categories, for the reuse and recycling of construction waste.
So far, four ‘éco-organismes’ have received REP Bâtiment approval: Ecomaison, Ecominero, Valdelia and Valobat.
